This article discusses policy and legal evolutions on the access rights to assisted reproductive technologies (ART) in contemporary China, and more specifically, on three case studies: the prohibition of ART and oocyte freezing for single women; the controversies on the right of surrogacy practice; the custody and transfer rights of frozen embryos for infertile heterosexual couples. Based on an analysis of the judgments within and outside the walls, this article aims to sketch the current landscape of ART practices in China and to make an analysis of the evolutionary trends in this field within a context where increasing the fertility rate has become one of the major concerns of the Chinese government. Demographic changes could lead to a relaxation of legal norms and ultimately lead to a pluralization of kinship structures.
