Conhecimento tradicional e propriedade intelectual nas organizações multilaterais Traditional knowledge and intellectual property in the multilateral organizations

Abstract

Neste artigo objetivamos discutir a proteção dos conhecimentos das populações tradicionais em sua estreita relação com a preservação dos recursos naturais e a proteção da propriedade intelectual. Para tal, são analisadas a compreensão que as organizações internacionais responsáveis pelo patrimônio (UNESCO), pelo meio ambiente (PNUMA) e pela propriedade intelectual (OMPI) têm de proteção. Além disso, também é comentada a visão da Organização Mundial do Comércio (OMC). Esse conjunto de órgãos multilaterais que tratam do tema indica a complexidade que envolve a definição de normas legais para a proteção nesse campo.In this article we aim to discuss the protection of traditional populations' knowledge in its close relation to natural resources preservation and the protection of the copyright. For that, we analyzed the understanding of protection that international organizations responsible for the heritage (UNESCO), for the environment (UNEP) and for the copyright (WIPO) have. The vision of the World Trade Organization (WTO) is also remarked. This set of multilateral agencies that deal with the subject indicates the complexity that involves the definition of legal rules for protection in this field.
