The right of migrant workers to decent employment in Mexico is fully recognized in various international instruments and domestic law, so that regardless of the migratory status that they have, the right to equality and non-discrimination are a the human right of ius cogens. Worker is the physical person who renders a personal work subordinate to another physical or moral person, while work is a right and a social duty, must be carried out in conditions that ensure a dignified life and health of the person who provides it and their dependents. Therefore, the migratory status of the person should not limit it to having access to decent work; free from discrimination based on ethnic or national origin, gender, age, disability, social status, with access to social security and a remunerative salary, and there are optimal safety and hygiene conditions to prevent work risks.
