In today's environment capital, a traditional instrument for creating competitive advantage increasingly being replaced by other instruments, especially knowledge resources . Resource management knowledge, especially new ideas and concepts, the basis of each company is able to change, adapt and create new opportunities to compete successfully in a changing business environment . This so-called ' human capital ' in the present, the era of the Internet, quick steps leading towards the role of the key factors of modern business. In such a business innovation, ie. innovation processes become the main factor of technological progress and economic development. However, innovations are not a product of modern society, already present since the beginning of human society. To modern organizations manage quality, it is necessary to have adequate patent strategy and good knowledge of the patent system in order based on their innovation could gain a competitive advantage - competitive, and thus operates successfully and achieve its goals. Intellectual capital, as the dominant factor innovation, has different characteristics from traditional forms of capital, for example physical assets. Accordingly its characteristics, it requires appropriate safeguards, which are most appropriate in the form of patents and the patent system.
