FAST FOOD RECIPE FOR SELF-PLAGIARISM IN LAW: TWO BATCHES OF HOMOGENIZING LEGAL EDUCATION AND ONE OF ACADEMIC PRODUCTIVISM - MIX EVERYTHING UNTIL YOU GET A WELL COMBINED MASS OF RESEARCHERS-COPYISTS - SERVE MODERATELY
Abstract
We observe an increasing concern with the phenomenon of self-plagiarism in the Brazilian academic environment. However, as this debate is still incipient on legal research, the problem remains raising questions and controversies, which increases the diffuse sense of insecurity among the various actors involved in the process: editors, authors, researchers, regulatory and research funding agencies in the undergraduate and graduate educations, among others. Through bibliographic research and observation, we used the hypothetical-inductive pathway, with the objective of mapping correlations between the homogenizing model of traditional legal education, academic productivism and the spread of self-plagiarism. We do not intend to establish a climate of "witch-hunt", but we understand that the scarcity of this debate can lead to a violation of the ethical imperatives of meritocracy, due to the unfair competition as a result of the distortion in the number of publications; which, on a macro level, implies in an increased redundancy and stagnation of legal knowledge.
