Serviciile publice. Considerații asupra legislației și practicii comunitare în domeniu, în contextul elaborării proiectului codului administrativ
Abstract
The Romanian Administrative Code represents the main outcome of the project “A more coherent legislative framework for a more efficient public administration”, financed through the Operational Programme for the Development of the Administrative Capacity and implemented by the Central Unit for Public Administration Reform within the Ministry of Administration and Internal Affairs. The public services field is one of those fields considered for inclusion in the Administrative Code. In this context, taking into consideration the insertion in the Administrative Code of the criteria for the classification of public services, particular relevance is attributed to the distinction in the community legislation and practice between the services of general economic interest and the non-economic services of general interest, given its impact on the application of European Union rules on state aid, public procurement and internal market.
