El peso del elemento subjetivo en el conflicto entre órganos constitucionales = Legal standing: the true conflict of the conflict between constitutional organs

Abstract

En el presente artículo se analizarán los sujetos legitimados para la interposición del conflicto de órganos constitucionales, regulado por la LOTC. Se sostendrá que la legitimación en los términos normativos resulta insuficiente para garantizar la organización constitucional. Así, se estudiarán exhaustivamente la restrictiva lista de sujetos legitimados y se discutirán los posibles sujetos a los que podría atribuírseles una legitimación alternativa. This article deals with the legitimated subjects to interpose the conflict between constitutional organs, as regulated by the LOTC. It will be argued that the legitimation conceded by the authoritative law is insufficient to guarantee the separation of powers (as constitutional organization). Therefore, this work will study all the currently legitimated subjects and will discuss possible subjects to which it could be granted the required legitimation.
