FOLOSIREA SITUAŢIEI DE SERVICIU LA SĂVÂRŞIREA INFRACŢIUNII DE LIMITARE A CONCURENŢEI LIBERE
Abstract
The use of the employment situation for committing the offence of free competition limitation (art.246 of the Criminal Code of Republic of Moldova) is analyzed in the present article. The ideas contained in the Law with regards to competition protection are developed and the possible hypotheses where the use of the employment situation might be admitted are underlined. The opinions of some well-known scientist are presented and at places debated.
