Remote control of workers' activities and the using of evidence in the trial

The dispositions contained in the new article 4 of the Workers’ Statute limit the monitoring powers of the employer and have been recently modified by article 23 of d. les. 151/2015.The faculty of the employer to use data and information collected by monitoring activities as evidence in a trial is a controversial matter.This paper focuses on the rules that restrict the use of such information in a trial.My analysis shows that article 4 expands the procedural use of the data but maintains significant limits that are aimed at protecting the employees’ privacy and rights.
