SOLUȚIILE INSTANȚEI ÎN RAPORT CU ACȚIUNEA CIVILĂ EXAMINATĂ ÎN CADRUL PROCESULUI PENAL
Abstract
Persoana căreia i s-a adus un prejudiciu în rezultatul infracțiunii are posibilitatea de a-și apăra dreptul încălcat prin exercitarea acțiunii civile în cadrul procesului penal, ceea ce constituie un beneficiu procesual acordat victimei infracțiunii de a valorifica toate elementele acumulate de procuror în acuzare, precum și întreg cadrul procesului penal, pentru a-și vedea satisfăcute interesele de ordin civil, patrimoniale sau morale afectate prin comiterea infracțiunii împotriva sa.Acțiunea civilă se rezolvă în cadrul procesului penal numai în măsura în care a fost alăturată învinuirii și, împreună, au ajuns în fața instanței penale.Instanța de judecată, soluționând acțiunea civilă, este competentă să o admită integral sau parțial, să o respingă, să admită în principiu acţiunea civilă, urmând ca asupra cuantumului despăgubirilor cuvenite să hotărască instanţa civilă. THE COURT’S SOLUTIONS REGARDING THE CIVIL ACTION EXAMINED IN THE CRIMINAL PROCEEDINGSThe person who has suffered damage as a result of an offence has the possibility to defend the violated right by exercising the civil action in the criminal proceeding, which constitutes a procedural benefit for the victim of the offence to use all the elements of the prosecutor in charge, as well as the whole procedural framework of the criminal process, in order to see its civil, patrimonial or moral interests satisfied that were affected by the offence against him.Civil action is solved during the criminal proceedings only insofar as it was joined to the accusation and arrived to the criminal court together with the accusation.The court judging the civil action has the following competences: to admit it in whole or in part, to reject it, to admit the civil action in principle, and to rule that the amount of compensation due, has to be decided by the civil court.
