LOS DERECHOS ESENCIALES O HUMANOS CONTENIDOS EN LOS TRATADOS INTERNACIONALES Y SU UBICACIÓN EN EL ORDENAMIENTO JURÍDICO NACIONAL: DOCTRINA Y JURISPRUDENCIA
Abstract
El presente artículo analiza la posición de los derechos humanos o fundamentales en el ordenamiento jurídico chileno, teniendo en consideración para ello el derecho constitucional positivo chileno y comparado, los tratados que contienen derechos esenciales ratificados por Chile y vigentes, la doctrina nacional y comparada, la jurisprudencia nacional, comparada e internacional. El artículo realiza un análisis crítico de la jurisprudencia nacional y plantea reformas necesarias para otorgar seguridad jurídica en el goce y ejercicio de los derechos en Chile.This article analyzes the status of Human Rights in the Chilean legal system, considering Chilean and Comparative Constitutional Law, international treaties on human rights ratified by Chile and currently in force, national and international scholarship, and national, comparative and international judicial doctrine. The opinions of Chilean Courts are critically assessed, and reforms are suggested that would improve the protection of human rights in Chile.
