Garantías de la autonomía municipal. La participación de los municipios en las instituciones autonómicas

Abstract

One of the most noteworthy and significant innovations of the Act on Local Entities of Euskadi is the regulation of the participation of municipalities in the autonomous institutions. The novelty lies in the fact that the participation does not appear as an expression of the generic right of local entities to intervene in matters that affect them; it is not an alternative to the allocation of powers but a guarantee of the entitlement and exercise of their own competences. It is a body bound to a procedure that municipalities use to assess the positive and negative impact of autonomous rules on their scope of action. The role establishes the composition: a body whose membership is exclusively of municipalities that exercises early warning and that goes beyond the right to be heard in order to deploy analysis and assessment functions with legal effects.
