This article analyses the legal protection conferred to traditional cultural expressions in Mexico, primarily from the perspective of intellectual property and copyright law. The protection of indigenous rights has a great importance for all nations, in particular for developing countries where folklore occupies an essential place in the cultural, economic and social life. The aim is to demonstrate that intellectual property law is not enough to effectively protect folklore and that the adoption of a parallel framework should be assessed.
