Abstract

This article offers some reasons that explain why Günther Jakobs should be read. Like what Odo Marquard calls "plurism of peculiarity" offers an answer to the question, but also, the fact that the past is a constant guest in the reflections on the present and in this, Jakobs shows the dark side of the criminal law that we should not see. The institutions must sacrifice the freedom of some in order to defend society, especially those who do not intergrate or assimilate.
