Distinctions between Disregard of Legal Personality and Accountability Staff

Abstract

This article aims to present the distinction of disregard of the institutions of the legal personality of personal responsibility and administrator partners . Although there is great confusion on the part of the doctrine and jurisprudence to apply the disregard of legal personality to the case , it appears that Brazilian legislation has several legal provisions relating to the personal responsibility of the member / administrator that need to be applied to instead of allowing exceptional as is the disregard of legal personality , injuring the principle of patrimonial autonomy.
