The draft bill of Penal Code submitted in July 2012 represents a serious attempt to fall back to pre-democratic criminal policies. As for abortion it turns to the legislation previous to 1985, criminalizing the abortion due to malformations in the fetus. The legal reaction to the irregular demonstrations is hardened, transforming passive resistance into a crime of assault on authority. The reform incorporates life imprisonment, revisable after 35 years, and “custody” (custodia de seguridad), a safety measure that adds an imprisonment of up to ten years to an already fulfilled prison. Finally, Book III of the Penal Code (misdemeanors) is suppressed, but raising a good part of misdemeanors to the category of crime.
