La regulación de la regulación económica en Francia: planteamientos doctrinales y previsiones normativas

Abstract

This article goes over the concept of economic regulation within the French system and its subjective element (the independent administrative authorities, IAA) by means of some of the more relevant academic contributions and from the sources of positive law and case law in the matter. Its aim or purpose is to see the derivation that a system closer to ours with the same legal tradition has met, its similarities and differences when envisaging a new model of public intervention in economy. It is specially interesting for that matter the idea of economic regulation as a new form of normativity, and specifically, the attention given to the topic of Soft law both by the doctrine and by a recent case law of the Council of State, and the other side the new normative regulation of the IAAs after the amendment introduced in January 2017.
