First-Ever EU Funding of Lethal Weapons: 'Another Taboo Has (Lawfully) Fallen'

Abstract

(Series Information) European Papers - A Journal on Law and Integration, 2022 7(1), 379-383 | European Forum Highlight of 8 July 2022 | (Abstract) This Highlight provides an assessment of the legality of the decision taken by the EU to supply weapons to Ukraine in the aftermath of the Russian invasion. It does so by analysing Decision 2022/338 as well as the decision on the European Peace Facility (EPF), on which the former is based, against the background of the scope of the CFSP competence and the case-law of the Court of Justice where the limits of such competence have been examined.
