LOCUL DREPTULUI DE MOŞTENIRE ÎN SISTEMUL DREPTURILOR ŞI LIBERTĂŢILOR FUNDAMENTALE

Abstract

În articol se abordează locul dreptului de moştenire în ierarhia garanţiilor fundamentale. Luând în considerare că acesta derivă din dreptul de proprietate, autorul opinează că cea mai adecvată calificare a lui este cea de libertate funda-mentală, deoarece dacă titularul dreptului de proprietate va fi îngrădit în posibilitatea de a dispune de bunurile sale pentru cauză de moarte, ar fi imposibilă realizarea dreptului de moştenire.PLACE OF INHERITANCE RIGHT IN THE SYSTEM OF RIGHTS AND FUNDAMENTAL LIBERTIES This article concerns the place of the right of inheritance within the hierarchy of fundamental safeguards. Bearing in mind that it emerges from the property law, the author considers that the most appropriate of his qualifications is the one of fundamental freedom, because the achievement of the right of inheritance would be impossible, if the holder of the property was restricted in the ability of disposing of his assets upon death.
