Reflections on the constitutionality of the Glacier Protection Law in the Argentine Republic

This paper executes a constitutional analysis of Law 26.639 of the Minimum Budget Regime for the Preservation of Glaciers and the Periglacial Environment in Argentina, with the objective of determining whether the aforementioned norm implies a violation of the National Constitution. For this, the main causes and antecedents that have motivated the constitutional debate of Law 26,639 will be exposed. Likewise, a hermeneutical study will be carried out that will have the purpose of examining the ruling of the Supreme Court of Justice of the Argentine Nation, entitled: «Barrick Exploraciones Argentinas s.a. and another c / National State s / declarative action of unconstitutionality», issued on June 4, 2019; to finally present as hypothesis the eventual constitutionality of the law.
