SEVERAL FACETS OF CONSTITUTIONAL RESPONSIBILITY OF THE STATE TO PROTECT HUMAN RIGHTS AND FREEDOMS
Abstract
The paper presents several facets of the problem providing a legislative framework for and exercise of constitutional responsibility of the state to protect human rights in the present-day national law. The influence of a particular society and state peculiarities on the implementation of international obligations with the respect to the protection of human rights and freedoms is studied herein. The author of the paper believes that effective protection of human rights and freedoms is unfeasible without deep interaction between international and national law, and without taking into consideration ratio decidendi of the European Court of Human Rights when Russian Federation legislation is applied.
