Abstract

La funzione della conferenza di servizi viene proposta come strumento di decisione complessa, utilizzabile nelle occasioni in cui è in discussione un mutamento dell’esistente. Si esamina l’evoluzione del trattamento degli interessi qualificati e trattati come pubblici, dalla fase delle tutele preventive a quella del confronto con altri interessi pubblici presenti nel medesimo ambito, proponendo che la tutela del patrimonio culturale non differisce dalla gestione di innovazioni, generazione del nuovo, rigenerazione di ciò che già c’è. La disciplina vigente può indurre sperimentazioni nelle amministrazioni di tutela, inducendole a mettersi in gioco in forme più attive e dinamiche, generando nuove abitudini professionali, limitando la capacità inibitoria all’indispensabile: così quanti gestiscono la tutela sono indotti a concorrere alle decisioni di modificazione dell’esistente, immettendovi valori culturali ed aumentando la qualità degli interventi esaminati dalle conferenze di servizi. The function of the service conference is proposed as a complex decision making tool, which can be used when a change of the existing one is under discussion. It examines the evolution of the treatment of interests qualified and treated as public, from the phase of preventive protection to that of comparison with other public interests present in the same field, proposing that the protection of cultural heritage does not differ from the management of innovations, generation of the new, regeneration of what already exists. The current discipline can encourage experimentation in the administrations of protection, bringing them into play in more active and dynamic forms, generating new professional habits, restricting the inhibitory capacity to the inevitable: so those who manage the protection measures are driven to contribute to the decisions to modify the current one, introducing cultural values and increasing the quality of the interventions examined by the conferences of services.
