Las licencias de uso de bienes digitales: el díficil equilibrio entre los intereses de los titulares de los derechos y los usuarios
Abstract
Esse artigo aborda as normativas aplicáveisàs licenças de uso de bens digitais. É possivelconstatar dois interesses opostos, assimnormatizados: Por um lado, as normas depropriedade intelectual favorecem os titulares dosdireitos em prejuízo da comunidade em geral e dosusuários em particular; por outro lado, a norma sobrecondições gerais da contratação e, principalmente, aproteção dos consumidores favorecem os interessesdos usuários de direitos. Assim, busca-se definir umequilibrio entre esses interesses, tendo em vista anatureza inovadora dos bens digitais.This article approaches normative theapplicable ones to the licenses of use of digitalgoods. He is possivel to evidence two opposinginterests, thus normatizados: On the other hand,the norms of copyright in general favor the bearersof the rights in damage of the community and theusers in particular; on the other hand, the norm ongeneral conditions of the act of contract and,mainly, the protection of the consumers favor theinterests of the users of rights. Thus, one searchsto to define a balance between these interests, inview of the innovative nature of the digital goods.
