TO THE QUESTION OF THE LEGAL GROUNDS FOR MEDICAL INTERVENTION WHEN RENDERING MEDICAL ASSISTANCE TO CHILDREN AND THE ROLE OF THE PROSECUTOR IN ENSURING FULFILLMENT OF THE RESPECTIVE REQUIREMENTS OF THE LEGISLATION

Abstract

The article analyzes the provisions of the current legislation to ensure implementation of the constitutional rights of children to health protection and medical care. Consider obtaining from the relevant patients, or their legal representatives informed voluntary consent to medical intervention. In addition, she discusses modern legal mechanisms aimed at ensuring the safety of other children in the society which can be of individuals who refuse medical intervention, and to protect, in this case, the rights and legitimate interests of children from unnecessary decisions and actions of their legal representatives. The paper is a review prepared on the basis of prosecutorial practices.
