Are we ready for AI in employment?
Abstract
The increasing use of artificial intelligence in employment seems inevitable. In addition to numerous benefits, it carries significant risks for employees. The authors of this article attempted to answer the question to what extent Polish labor law is ready for the challenges posed by the use of artificial intelligence in employment and what possible actions should be taken to provide employees with an adequate level of protection against potential threats that may result from the use of artificial intelligence in employment. For this purpose, the authors identified the areas where the greatest threats related to the use of artificial intelligence are perceived and analyzed the currently existing legal protection measures that can be used to guarantee this protection. Then—if it is determined that the state of this protection is insufficient—they try to formulate de lege ferenda postulates aimed at filling the gaps in this area.
