This article aims to present the development of the concept rule of law, indicating its origin and evolution of the original model to the present day worldwide, analyzing how the phenomenon occurred before the Brazilian peculiarities, where the current democratic state model of law is taken from the perspective of ensuring respect for civil liberties, human rights and fundamental guarantees, despite the general lack of inclusion in the legal system. The comprehension of these transformation is important for a better understanding of the state dynamics in countries that suffers from a vulnerable democratic basis and with chronic disregard for guarantees and individual freedoms.
