Private Waqf in the Algerian Legislation Between Codification and Abolition

Abstract

Abstract: The legislative movement of waqf system in post-colonial Algeria has undergone improvement and great change. Private waqf, along with public waqf, has undergone successive codification operations not only in special texts but also in texts relevant of waqf as a whole. However, the private waqf was abolished according to 02-01 law. This article aims at unveiling the intention of the legislator and the reasons behind the private waqf abolition. The legislator made it clear according to the law mentioned earlier that private waqf would no longer enjoy a special status and thus has to comply with the public waqf regulations in force.
