O conflito, o monopólio estatal de seu tratamento e a construção de uma resposta consensuada: a “jurisconstrução”
Abstract
A função jurisdicional, atualmente aindamonopolizada pelo Estado, já não oferece respostasà conflituosidade social, passando por umacrise que demanda a busca de alternativas. Nestestermos, o presente artigo tem como escopo fundamentaldiscutir o conflito e as suas possibilidadesde tratamento. Todavia, analisar-se-á especificamentea conflitualidade social traduzida emconflitualidade judiciária, ou seja, na litigiosidadeque busca resposta no aparato judicial. Assim,delimitado o significado da palavra conflito, o desempenhoda jurisdição e a lógica exercitada peloEstado no seu tratamento será objeto de estudo.Paralelamente discutir-se-ão outras formas de tratamento,mais democráticas e autonomizadoras,“jurisconstruídas” pelos litigantes.The jurisdictional role, currently aState’s monopoly, does not offer answers for theconflicting society, which goes through a crisisphase demanding a search for alternatives. In thoseterms, the present work has as its main scope thediscussion of the conflict and the possible pathsto address it. Yet the social conflicts are to beanalyzed, which translates into a conflicting judicialissue, that is, litigation that searches answersin the judicial structure. Thus, being the meaningof the word conflict limited, the judicialperformance and the logic exercised by the Statein facing it, will be one object of this study. At thesame time other more democratic and freed waysto deal with the issue, and “judicially built” bythe litigants, will be discussed.
