NONMUTUAL COLLATERAL ESTOPPEL AND THE STARE DECISIS

Abstract

An approximation between the nonmutual collateral estoppel and the stare decisis has been object of a very important discussion in the US law. As the Code of Civil Procedure of 2015 attends to both issues (articles 503, 926 and 927 of the Code), it is extremely opportune to participate of the discussion that has been held in one of the countries that has developed the topic the most.
