The problem of forming legal alienation phenomenon at establishment of social institutes of law
Abstract
The paper considers the concepts of the right and legal alienation. The author has stated the preconditions of legal alienation occurrence in society by the example of Russian society in transition period and in modern realities. The relevance of the study is connected with the progressive growth of different manifestations of legal alienation in the society. Manifestation of this phenomenon, in particular legal nihilism of citizens, has a disastrous influence on all spheres of the state development: social, economic, political, spiritual and others. The society gravitating towards the execution and respect of legal rules, developed and accepted in the society, is the guarantee of progress of any state. Only in such conditions the society can develop and hope for prosperity and successful development. The purpose of the study is to identify the conditions of legal alienation removal through the society humanization. The main methods used in the study are the axiomatic and hypothetico-deductive ones. The result of the study is the formulated criteria for overcoming legal alienation in the society. The problem is considered by the example of the modern Russian state.
