FICTITIOUSNESS OF CIVIL PROCEDURE: CONSTITUTIVE SIGNS AND MECHANISMS OF PROHIBITING ABUSE OF PROCEDURAL RIGHTS IN THE RUSSIAN FEDERATION

Abstract

The authors analyze the current Russian legislation for civil and arbitration procedure the regulating the category of abuse of rights. The analysis provides an independent concept of "abuse of procedural rights", and through it reveals the features of fictitious civil procedure.
