Aspectos político criminales del delito de violencia intrafamiliar en Colombia

Abstract

A criminal policy exam of the laws that regulate intrafamily violence in Colombia allows one to distinguish between the special protection of women against violence, on one hand, and family protection as a legally protected collective good, on the other; this distinction enables one to observe important dogmatic consequences. In addition, prelegislative and legislative phases of these laws evidence a pluralistic and conjunctural character that influences the technical quality of the law’s precepts; while the postlegislative phase remains inactive due to the assumption of legitimacy of the legislative initiatives in this subject, despite none of them fulfilling the legislative rationality parameters that could be demanded.
