Abstract

In current legal turnover significant importance is attributed to investments in the field of renevable enrgy (in praticular wind energy). In this scope, regarding relatively short time of practice developement, there may be noticed a number of legal issues, especially referring legal qualification of wind contract (land lease). Therefore aim of this paper is, firstly, to point out the primary characteristic legal features of the above-mentioned contract. Thus there are presented issues regarding the cotract’s title, legal entities entering into this cotract and refered by this contract, it’s subject, form and term, principle duties of the cotracting praties, as well as rights of third parties and, finally, expiration of contract. Secondly, this consideration would be profitable towards an attepmt on determining the legal qualificaion of wind contract (land lease) along with indicating which of the civil code’s provisions shall be applicable.
