The Priority Question of Constitutionality and the Conventionality Control in French Legal System

Abstract

The French legal system has gradually incorporated the international law in its domestic law, with some exceptions due to the remnants of its legal nationalism. However, the introduction of judicial review of the domestic laws in force by the Constitutional Council, it has caused imbalance in this relationship. The present work object is to ascertain the relationship between the control of conventionality and the priority question of constitutionality, in order to check is the connection is confrontational or even if there is a confusion between their skills. We'll use dialectical method. The literature review will be the primary source.
