The central theme of the article is the presentation of the arguments in favor of the right to cultural identity and the discussion about its limits. It aims to show the problem involved in the claim of differentiated identity in education and explore the consequences that its unrestricted application may have for educational policies that integrate freedom and equality. Following an exploratory, explanatory and descriptive methodology, the text begins by exposing the current cultural identity and its scope; then re-read the concepts that affect him, particularly those of education, culture and cultural identity; then addresses the right to cultural identity and its content; then examines the positions that drive the development of cultural identity; Finally, some of the means of promoting this development and its limits in relation to the right to education are discussed. It concludes by basing the need to host the debate of cultural identity as part of the right to education, but preserving social cohesion.
