Constitutive Elements of a Critical Theory of Justice
Abstract
The article presents a version of the critical theory of justice structured on the basis of the grounding program for discourse ethics, taking the principle of responsibility introduced by K. O. Apel, as a normative guide for intervention in real-world societies. This guide, which is specified in the condition of subjects of dialogue, makes it possible to identify and develop the theory’s constitutive elements. Capacities, as a metric of justice, and a sufficientarian principle that works jointly with that of difference are the elements that aim to ensure the condition of subjects of dialogue.
