Constitutional and legal foundations for countering terrorism using cyberspace

Background. The article is devoted to the constitutional and legal foundations of countering terrorism using cyberspace. With the development of digital technologies, crimes using the Internet have become more and more prosperous. Modern terrorism is characterized by complexity, multidimensionality and multiplicity of its manifestations. States are suffering serious resource losses, terrorism is penetrating into all aspects of the life of society and the state, using various methods. Currently, there is no universal tool to counter this area of terrorist activity, which predetermined the relevance of this study. The purpose of the article is to form the concept of the constitutional and legal framework for countering terrorism using cyberspace. Materials and methods. The implementation of this goal was achieved by analyzing the norms of Russian legislation, in particular the Constitu-tion of the Russian Federation, federal laws, judicial practice, statistical data and the provi-sions of legal science. The methodological framework is presented by methods such as comparative legal, formal legal and systemic structural. Results. On the basis of federal legislation, the constitutional and legal foundations and materials of legal practice on coun-tering terrorism using cyberspace are analyzed, problems are identified that require special attention from the state, and proposals are made related to the specifics of countering terror-ism in cyberspace. Conclusions. Terrorism committed using cyberspace poses a great threat to Russian society and the state. In view of the insufficient elaboration of the current legis-lation, it is necessary to further improve the constitutional and legal framework for counter-ing terrorism.
