Starting from the analysis of religious freedom proposed by the Conciliar Declaration Dignitatis Humanae, this paper analyses historically and conceptually the process that goes from that Declaration to its development around what has been called positive laicism. This, confronted with a supposed intransigent laicism, can be understood as a logical consequence of the conception of religious freedom that emerged from the Second Vatican Council. The political and judicial changes, derived from different conceptions about the above elements, defined the development and implementation of religious freedom in Spain after 1978.
