STABILITY, IMMUTABILITY OF THE ANTICIPATED EFFECTS AND THE EFFECT OF RES JUDICATA: AN IMPROVED VERSION

Abstract

This paper has the objective of analyze the concept of stabilization of the antecedent anticipated decision, introduced by the Civil Procedure Code of 2015. It will be done a doctrinaire review and, after, it will be defended that the stabilization implies only the immutability of the anticipated effects, as well as the consequences of this doctrinaire position.
