EL SISTEMA INDEMNIZATORIO DEL TRIPLE COMPUTO EN LA LEY DE PROPIEDAD INDUSTRIAL
Abstract
El sistema indemnizatorio del triple cómputo ha sido adoptado por la ley chilena de propiedad industrial (LPI) en su artículo 108. Sin embargo, este precepto dista mucho de ser uno de carácter estrictamente indemnizatorio, por el contrario, adopta al menos dos formas de enriquecimiento sin causa que son analizados a la luz del Derecho Civil y la naciente influencia del Derecho de Daños en este artículo.The compensation system of the "triple computation" has been adopted by the Chilean law of industrial property in their article 108. However, this precept it's faraway of being strictly one of compensation character, it adopts two enrichment forms at least without cause that they are analyzed under the Civil code rules and the day by day more stronger influence of the strict liability.
