This paper on the statutory quest for truth in class and group actions intends to provide an overview of the social state of law, from which they have arisen and which endows them with meaning. Inquiring about the purpose of contemporary processes in fact finding for conflict resolution, and defining the judge’s powers in this context, this paper aims to perform a succinct analysis about the burden of proof and its mechanisms in compliance with Act 472 of 1998 and jurisprudence by the Supreme Court, the Civil Hall and the State Council.
