El derecho de consulta previa en la transición energética mexicana
Abstract
This paper presents the case study of the application of the Prior Informed and Free Consultation for the evaluation of a project of wind farm in Juchitán, city in the south of the Isthmus of Tehuantepec in Mexico where currently operates the largest wind farm series in Latin America. As an official mechanism, the Prior Consultation seeks to build social consensus and protect the human rights of the indigenous population. Nevertheless, we argue in this paper that without a specific public policy to solve the problems of wind farm planning, and without changes in the current top-down planning management, its application remains illusory and cannot guarantee the protection of the rights it seeks to defend.
