TAKING THE DUTY TO ENCOURAGE SELF-COMPOSITION SERIOUSLY: A PROPOSAL TO REVISE THE ACCESS OF JUSTICE UNDER THE BRAZILIAN CIVIL PROCEDURAL LAW

Abstract

The present paper about access of justice discusses the general rule of Brazilian Civil Procedure Law (2015), which establishes the duty of everyone to encourage the consensual solution of conflicts and, as such, investigates the possibility of conditioning the access to the Courts of a previous attempt to solve the conflict out of it, especially through online platforms as consumidor.gov.br
