Mortgage rights provide the right for the creditor to sell the object of the mortgage on his own power through a public auction and take repayment of receivables from the proceeds of the sale to the defaulting debtor known as the Mortgage Execution Auction. The refusal of registration of the transfer of rights through an auction by the National Land Agency (BPN) on the grounds that there is still a dispute over land often results in a lawsuit from the auction purchaser of the execution of Underwriting Rights in the District Court and the State Administrative Court (BPUN). This writing method in this writing by using the type of research is doctrinal legal research (doctrinal) or normative, which examines law as the norm. The results of the discussion confirmed that Minister of Agrarian and Spatial Planning Number 13 of 2017 has provided legal protection for auction buyers to make requests for the transfer of rights to land purchased even though there is a dispute but also this regulation is considered to derogate some of the rights of auction buyers.
