Abstract

What is the effect of the European social policy on changes of labour laws and employment relations in national legal orders ? This study proposes to examine the impact of the Alain Supiot’s Report (« Au-delà de l’emploi », 1999), of the European strategy of flexicurity and of the crisis of 2008 on the traditional national models of labour law and employment relations. They seem to lead to a “distributive” application of the protective labour rules.
