CONFRONTATION TACTICS INVOLVING MINORS IN THE CONTEXT OF USING DIGITAL TECHNOLOGIES: CONTINUATION OF THE IDEAS OF PROFESSOR LEV LVOVICH KANEVSKY
Abstract
The purpose of the study is to identify prospective directions for the development of criminalistic knowledge in the production of confrontations involving minors. Research objectives: 1) to review the scientific ideas of Professor L.L. Kanevsky; 2) to analyze modern legal positions of the Constitutional Court of the Russian Federation on the status of a minor; 3) to highlight the importance of criminalistic knowledge on the methodology and tactics of confrontation involving minors; 4) to justify the use of digital technologies in obtaining the testimony of a minor in order to ensure safety during confrontation; 5) to highlight the importance of international standards of juvenile criminal procedure. Research methods: dialectical, historical-legal, comparative-legal. The article substantiates the opinion on the need for further in-depth analysis of the system of tactical procedural decisions when interrogating a minor. The criteria for the variability of testimony and the conditions for the use of video and sound recordings in confrontation are defined; tactical solutions are proposed for remote (via videoconference) confrontation involving a minor.
