The present study has as general objective to present the Brazilian and Spanish legislation devoted to the information access and to public transparency. As specific objectives it is aimed to understand the evolution of the legal predictions on right to the access and transparency of public information in a world-wide context and particularly in the case of Brazil and Spain, as well as to analyze comparatively the access to information laws in both countries. For this purpose it is developed a bibliographic, descriptive-analytical and comparative research, through content identification and analysis. Foom the results obtained it is possible to perceive the evolution of the legal predictions on informational access and secrecy, and consistently, on the public transparency, as well as similarities and discrepancies between both legislations.
