Abstract

The work analyses an institution that the Italian law only provides for the protection of IP rights: the so-called “descrizione cautelare” regulated by the I.P. Code. The analysis is focused on the issue of digital evidence and the possibility of using evidence acquired through descrizione cautelare but relating to non-IP rights.
