This study intends to examine the arguments for and against the adoption of corporate criminal liability for crimes against the environment. Although this kind of responsibility is provided in the Constitution and the Environmental Crimes Law, the issue is controversial because of the criminal law dogmatics establishes the subjective responsibility, and this is the purpose of this article. To achieve the research objectives, the deductive method was used, through literature review on the law criminal books, in order to demonstrate that the criminal intervention is not necessary to punish the legal persons.
