Abstract
The recent decision No. 26972 of the Italian Supreme Court (United Sections) of November 11, 2008 fixed the correct interpretation of law about “non pecuniary loss” and the principles that must be applied by the other Italian courts. Nevertheless some aspects of the interpretation provided by the Italian Supreme Court are not so easily applied and the first cases after the decision named above present some problems. This study analyses the critical aspects and the questions presented by the decision of the United Sections’ Italian Supreme Court and the subsequent decisions of the Italian judges.
